Refund policy

Introduction
This Returns Policy applies to the purchase of dental equipment and supplies by business customers (“Purchasers”) from HSP Engineering Ltd (“Seller”). This policy is an integral part of the Terms and Conditions of Sale and outlines the rights and obligations related to the return of products, claims, and refunds.

Eligibility for Return
Products are eligible for return only under the following conditions:

Defective Products: Products that exhibit significant manufacturing defects or fail to operate substantially in accordance with the specifications as described in the Order Confirmation.

Incorrect Products: Products delivered that do not match the models, specifications, or quantities explicitly listed in the Order Confirmation.

Damage during Delivery: Products that have been materially damaged during transportation to the Purchaser’s designated location, provided that the Purchaser notes such damage on the delivery receipt at the time of delivery.

Exclusions
The following items and circumstances are excluded from this Returns Policy:

Consumable Components: Items such as batteries, seals, and other consumable parts that are subject to normal wear and tear or have a limited lifespan.

Improper Use or Modification: Products that have been misused, improperly installed, improperly maintained, modified, or repaired by the Purchaser or any unauthorized third party.

Damage from External Factors: Damage caused by external events, environmental conditions, power supply issues, or mishandling during installation or use by the Purchaser.

Cosmetic Damage: Minor cosmetic defects or damage that do not affect the functionality or performance of the product.

Customized or Special Order Products: Products that have been customized or specially ordered at the Purchaser’s request.

Products Sold “As-Is”: Any products sold as clearance, close-out, or marked as “as-is” or “non-returnable”.

Return Conditions and Process
To initiate a return, the Purchaser must strictly adhere to the following conditions and process:

a. Inspection upon Delivery: The Purchaser is responsible for inspecting the products immediately upon delivery.

b. Notification Requirement: The Purchaser must notify the Seller in writing of any defects, discrepancies, or damages within three (3) working days of delivery. Notifications should be sent via email to sales@hspengineering.co.uk and must include:

Order number
Detailed description of the issue
Photographic evidence of the defect, discrepancy, or damage
c. Acceptance of Products: Failure to notify the Seller within the specified time frame shall constitute irrevocable acceptance of the products, and the Purchaser waives any right to reject the products thereafter.

d. Return Merchandise Authorization (RMA): Upon receiving the notification, the Seller will review the claim and, at its sole discretion, issue a Return Merchandise Authorization (RMA) number if the claim is deemed valid. No returns will be accepted without a valid RMA number.

e. Return Shipping: The Purchaser is responsible for the safe, secure, and insured return of the products to the Seller at the Purchaser’s expense. The Seller assumes no liability for products lost or damaged during return shipping.

f. Condition of Returned Products: Returned products must be in their original condition, including all accessories, manuals, and original packaging, and must not show signs of use beyond what is necessary to identify any defects. Products that are damaged, used, or altered will not be eligible for return.

Remedies
Upon receipt and verification of the returned products, the Seller, at its sole discretion, may offer one of the following remedies:

Repair or Replacement: The Seller may arrange for the repair or replacement of defective or damaged products within a reasonable time frame.

Refund: If repair or replacement is not feasible, the Seller may issue a refund for the defective or incorrect products. Refunds will be processed using the original payment method, less any applicable restocking fees.

Restocking Fees
The Seller reserves the right to charge a restocking fee of up to 20% of the product price for any returned items, except where the return is due to the Seller’s error.

Limitation of Liability
To the fullest extent permitted by law, the Seller’s total liability under this Returns Policy shall be limited to the purchase price of the products in question. The Seller shall not be liable for any indirect, special, incidental, or consequential damages, including but not limited to loss of profits, business interruption, or loss of business opportunity.

Warranty
This Returns Policy does not override any Warranty terms provided under Clause 5 of the Terms and Conditions of Sale. For details on Warranty claims and exclusions, please refer to the Warranty section of the Terms and Conditions. The Purchaser acknowledges that the Seller excludes all other warranties, conditions, or terms, whether express or implied, to the fullest extent permitted by law.

Governing Law and Jurisdiction
This Returns Policy shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts of England and Wales.
